Tóm tắt The Principle of Double Criminality is a basic principle of universal in the international criminal judicial assistance, which was first developed in the field of extradition,and then apply to other areas including judicial assistance in criminal cases,transfer of criminal litigation jurisdiction,recognition and enforcement of foreign criminal judgements and international cooperation in confiscation.The Principle of Double Criminality is the basic requirement and reflection of legal principle and national sovereignty,and it has special significance to safeguard the national judicial sovereignty and the rights of citizens. Under the macroscopic background of the global integration and strengthening of the rule of the international law,although there is reason to exist,the Principle of Double Criminality has been a flexible use,including weakening and exceptions.
Tóm tắt 双重犯罪原则是在引渡制度基础上发展起来并成为狭义刑事司法协助、刑事诉讼移转管辖、外国刑事判决的承认和执行以及没收国际合作等国际刑事司法协助范畴中具有普适意义的基本原则。双重犯罪原则是罪刑法定原则和国家主权原则的具体体现和基本要求,对保障国家司法主权的实现和保障公民权利具有特别重要的意义。但在全球一体化和加强国际法治的宏观背景下,双重犯罪原则虽仍有存在的合理理由,但其适用已经趋向灵活,甚至出现了弱化乃至例外情形。
