Tóm tắt Is the corruption of village cadre a social problem,or institutional one?The discussion of the corruption of village official actually confused an essential issue:village official is not really official at all,who is a member of autonomous community of the society,at least in law.In another words,his corruption is resulted from that he is at juncture of two systems,which is state administrative one and society autonomous one.In addition,the genesis of his corruption is the paradox of the governing logic of present institution,and the disorder of the normal relationship between state power and society right.The corruption of village official signifies the power conflict of‘official governing’and social autonomy,the former is based on state power and the latter society one.The key to clamp down the corruption of village official is to differentiate administrative power and autonomous right,fixing the principle of society autonomy by rule of law.
Tóm tắt 对村官腐败的讨论混淆了一个实质性问题:村官不是官,他是社会自治体的成员,至少法理上如此。换言之,他的腐败恰好是因其身处两个体制——国家行政体系与社会自治体系之交界处,而且他腐败的根源恰好是现行体制治理逻辑的自相矛盾和国家与社会之间权利关系的规范失序。在腐败的村官身上体现的是官治与民治的权力冲突,前者基于的原则是国家权力,后者基于的原则是自治体的自治性与社会权力。防止村官腐败,关键是将村官双重代理身份剥离,将行政权与自治权做出区隔,并把社会自治以法治的原则确定并规范下来。
