Tóm tắt This article takes the meaning and objective of Shang Yang’s Law as its starting point,which can help us have a better understanding of Shang Yang’s law-ruling thoughts.Shang Yang’s thoughts centered in"ruled the country by law",formed and expanded around "agriculture strategy".The principal part of the statesmanship is emperor in his law-ruling thoughts,but making the whole country rich and its military force strong is not the only purpose in his ideology,"all-people self-governance","the whole world’s stable","re-establish the highest moral"and "inherit the virtue in society"are the other political ideas to be achieved.From the political philosophy’s perspective,Shang Yang’s Law reflects the function,value and spirits of law-ruling.
Tóm tắt 以商鞅之"法"的含义和目标为切入点,有助于理解商鞅以"以法治国"为中心,围绕"农战"而形成并展开的法治思想。商鞅"以法治国"的主体虽是君主,但"以法治国"除了要达到富国强兵的目标外,还要实现"万民自治"、"天下大治"以及"至德复立"、"能述仁义于天下"的政治理想。在政治哲学视域,商鞅之"法"体现出法治的功能、价值和精神.
