Tóm tắt Engaging aircraft to transport dangerous substances and escaped convict in an illegal manner are two kinds of transportation crimes added by Beijing Convention when revising traditional International Aviation Security Conventions.As a party of Beijing Convention,China is obliged to fulfill its obligations under the convention by fighting against such crimes through transformation of domestic criminal law.Hence we do not only need to analyze the criminality of such operation based on the theory of Chinese criminal law to establish a foundation to make a legislative response,but also need to compare relevant accusations in light of criminal law so as to guarantee the connection between the Convention and our criminal law.
Tóm tắt 使用航空器非法运输危险物质和非法运输逃犯是《北京公约》对传统《国际航空安保公约》修订时新增的两类非法运输类犯罪行为。我国作为《北京公约》的当事国理应履行承担的公约义务,通过国内刑法的转化实现对此类犯罪的打击。基于我国刑法理论分析此类行为的犯罪构成是立法作出应对的基础,结合刑法相关罪名的比较是解决公约与我国刑法衔接问题的保证.
