Tóm tắt As a provincial administrative organ in the Ming Dynasty,buzhengsi( provincial administration commission) played a significant role in local affairs. Up to the present,little research has been done in discussing its judicial function. Centering on Sichuan Local Judicial Archives,a unique Ming collection of local archives,this essay explores the operation of buzhengsi in legal procedure: from case filing and hearing to case reviewing. By examining the judicial function of buzhengsi,this essay sheds new light on our understanding of both legal and administrative arrangements at the provincial level in the Ming Dynasty. It illustrates that the judicial authority was an open system. It required officials from different commissions to cooperate in dealing with law cases,so as to achieve fairness.In the Ming Dynasty,judicial responsibilities at the provincial level were actually shared by three interacting commissions: buzhengsi,anchasi( surveillance commission) and dusi( regional military commission).
Tóm tắt 明代布政司掌一省之政,主管民事,既往研究对于明代布政司在司法中的作用鲜有关注。通过《四川地方司法档案》这一目前仅见的明代地方司法档案,可以发现明代布政司在立案、审问以及详谳等司法过程中均发挥了重要作用。在明初设计的省级司法格局中,布政司、按察司、都司均有自己的位置和职掌,省级司法没有、也不可能全部归属按察司,布政司在司法中的作用不可替代。在司法实践中,因为百姓告诉相对自由,案件司法权相对开放,在追求公正无枉的目标下,布政司、按察司与都司在司法中的协调与牵制明显。本文从讨论布政司在司法中的作用出发,分析和展示明初的地方司法格局;并以此视角,重新审视明初地方最高机构,即都、布、按三司之间的关系。
